Questions, questions, questions

Hi all,

I know some of you will have or be just about to complete your final sacs for the year! So well done to you all. Im well aware of the stresses and worries that you are facing.

Ive gone through this period once for two subjects, im now doing it again with four.

Some advice from a survivor. Things may seem difficult, if not near impossible at times, but keep plugging away. There is only a couple of months to go so you are on the final push!

My suggestion is to get those notes sorted pronto! I dont suggest that you rewrite all those notes you have taken this year. This is the point where summaries are crucial. Pick a topic, sit down and write out what you remember purely off the top of your head. From there collate the information from your notes into brutally concise dot point form. You want it so that it is a summary which triggers your memory, not states every single word. If anything, just summaries it with the key mark words and remember that. then on the day just run through that stream of words and connect the dots!

In the month before the exam I did a paper a day so make sure you get on to your teachers, and other teachers and track down as many as possible! they are the best possible form of revision. I also cannot speak highly enough for check points. Use those to get to grips with questions you struggle with but then get back on the papers!

Criminal Procedure – Question 4

Hi All,

Describe and evaluate one sanction available to the courts.

The most severe punishment available to the courts in criminal matters is imprisonment. Imprisonment involves the removal of an individual from society and his/her detainment in a prison facility. The main purpose is to deter individuals and society at large from committing crimes so as to be able to avoid imprisonment. At this, imprisonment is very effective. An alternative purpose of imprisonment is rehabilitation, despite this aim the rate of recidivism in Victoria remains high at 36% demonstrating that the imprisonment is ineffective at achieving this purpose as individuals continue to reoffend.

Criminal Procedure – Question 2

Hi All,

I figured it was about time to give you some questions given you are all well and truly into the notes and theory.

I found that DTO’s are solid as they are a recent addition to the system, if i remember correctly. Accordingly I used it as recent improvements to the system as well

Describe one sanction available to a court in a criminal case and explain and evaluate two of its purposes.

One sanction that is available to the courts is Drug Treatment Orders (DTOs). In this, the court can order an individual to submit to tests, detoxification and treatment if it is determined that the defendant is dependent on either drugs or alcohol. The main purpose of the DTO’s is to rehabilitate the offender and resolve their dependency, studies have shown that 23% of individuals who participated in the judicially-supervise rehabilitation program were less likely to reoffend and full time employment rates almost doubled from 11 to 25%. This is beneficial as it works to reduce the number is people in our community that are dependent on drugs, improving safety and decreasing drug related crime levels. Another purpose of DTO’s is deterrence, as offenders subjected to treatment are discouraged from committing further crimes as they would lead to definite jail time. This is advantageous for society as it encourages rehabilitation to prevent themselves from being imprisoned.

Criminal Procedure – Question 1

Hi All,

I figured it was about time to give you some questions given you are all well and truly into the notes and theory.

A taster of what is to come although I am a bit low on questions for this topic. If you have any, just ask them and ill do a break down about how Ill respond to them 🙂

“Pre-trial procedures are designed to speed up the resolution of civil disputes”.

Comment on this statement and describe one civil pre-trial procedure in you answer. (5 marks)

The civil pre-trial procedure of Pleadings is designed to encourage the timely resolution of disputes by clarifying the issues of the case, informing both parties of the standing of the other party and providing information regarding the type of remedy being sought prior to the beginning of the actual hearing.

The procedure of Pleadings includes the Statement of Claim, which is filed with the writ by the plaintiff in the Supreme Court. The purpose of the statement of claim is to inform the defendant that action is being commenced against them, the accused facts of the case and the remedy being sought. The Defendant then responds with a statement of defence which outlines their version of the facts and provides them with the opportunity to accept or deny the allegations again them. Pleadings are concluded with the optional counter claim, in which the defendant informs the plaintiff that they believe that their rights have been infringed and are commencing legal action of their own. Counter Claims provide the courts with further information regarding the case and enables them to determine who’s is more probable.

The crucial purpose of pleadings is to aid the parties in the preparation of their case prior to its presentation during the court hearing.

Unit 4- Aos 1

Hello Ladies and Gentlemen,

I’d like to appologise for my recent hiatus.

If I’ve got the right end of the stick the majority of you are about to start, or all ready have started doing Unit 4- Area of Study 1.

And if I’ve still held onto the stick that means you are looking at topics including the reason for the court hierarchy, the jurisdictions and the methods of dispute resolution used by each court and the alternatives.

If this is the case could you do me a favour and leave a quick comment to let me know im on the right track.

Tomorrow im going to start posting a series of questions and answers. As well as a few comments about why I’ve structured them as I’ve had and things that I feel are in general valuable.
